Calcutta High Court stopped Parle from using ‘TOP GOLD STAR’ brand name until 27 August

On 19th July,2024 Hon’ble Justice Krishna Rao, prohibited Parle from marketing and Selling it’s product under brand name ” TOP GOLD STAR” until 27 August 2024.

As of this date, Bisk Farm is the only registered user of the mark TOP GOLD in Class 30.

Parle has allegedly violated Bisk Farm’s registered trademark “TOP GOLD” by fraudulently adopting “TOP GOLD STAR,” in which the terms “TOP” and “GOLD” are written in larger font and the term STAR is written in smaller font.

This is used in connection with the same items, i.e., biscuits, and is structurally, alphabetically, and/or misleadingly comparable to the Bisk Farm TOP GOLD mark.

In an attempt to stop Parle Biscuits from using the “TOP GOLD STAR” mark, Bisk Farm petitioned the Calcutta High Court, arguing that this is an obvious case of passing off.

“We have a distinguished history of introducing distinct biscuits, each marked by its own unique identity, all of which have been well-received by consumers,” stated Vijay Singh, managing director of Bisk Farm.

We are committed to defending our brand integrity and intellectual property rights, which our late founder K.D. Paul tirelessly developed over the course of two decades.

After this Vijay Singh, managing director Bisk Farm thanked the honourable court for issuing an order against this action of trademark infringement by Parle.
