The Delhi High Court issued an injunction in favor of Amul, the largest dairy brand in India, against Terre Primitive, an Italian company, in a significant case involving cross-border trademark infringement.
The Italian company had been using the name “Amuleti,” which was a close reference to the trademark of popular brand of Amul, to sell cookies and biscuits wrapped in chocolate.
Gujarat Cooperative Milk Marketing Federation, which sells dairy products under the Amul brand, filed the lawsuit with the help of counsel Abhishek Singh.
Singh contended that Amul, a well-known brand in India, has a reputation throughout the world and is ranked eighth among the top dairy organizations in the world.
By simply adding the word “eti” to the mark, Singh said that Terre Primitive had “blatantly” replicated the script, style, and way in which “Amul” was portrayed.
The Italian company is prohibited from using or dealing with any marks that are identical to “Amul” by Justice Mini Pushkarna, who also ordered them to take down the infringing products from their website.
The Italian company’s social media profiles endorsing the aforementioned products were directed to be blocked or removed by Meta Inc.
Gujarat Cooperative Milk Marketing Federation managing director Jayen Mehta described the ruling as a win for Amul and a set standard for shielding homegrown trademarks against international copying.
