Advisory Released by FSSAI Regarding the Unauthorized Commercialization of Human Milk and its Products

On May 24, 2024, the Food Safety and Standards Authority of India (FSSAI) released a warning regarding the unauthorized Commercialization of human milk and its derivatives.

According to FSSAI, human milk processing and/or selling is prohibited under the FSS Act, 2006, and its associated rules and regulations.

Hence, it is recommended that all activities involving commercializing human milk and its products be stopped quickly.

Failure to comply may lead to legal action being taken against the Food Business Operators as per the Food Safety and Standards Act, 2006, and its associated regulations.

Unauthorized Commercialization of Human Milk

Additionally, it is essential for both the State and Central Licensing Authorities to guarantee that no license or registration is provided to any Food Business Operators (FBOs) engaged in the processing or sale of ‘Mother’s milk/Human milk’.

In the past, FSSAI has observed similar incidents and took action in October 2022 by suspending the FSSAI license of a food business operator.

The appropriate authority has approved this.
