FSSAI Notifies Food Businesses Regarding Supreme Court Order on Misleading Advertisements

On November 11, 2024, the Food Safety and Standards Authority of India (FSSAI) released an advisory to all food business operators (FBOs) in response to a Supreme Court order designed to combat misleading advertisements

This is to inform all FBOs that the Hon’ble Supreme Court has issued directives stating that before the printing, airing, or displaying of any advertisement, a self-declaration must be submitted by the advertiser or advertising agency on the designated portal. This declaration must certify that the advertisement complies with the advertising code outlined in the Cable Television Networks Rules, 1994.

The advertiser shall provide proof of the self-declaration upload to the concert broadcaster, printer, publisher, TV channel, or electronic media, as applicable, for their records.

In accordance with the directive from the Hon’ble Supreme Court, the Ministry of Information and Broadcasting has launched a new feature on the Broadcast Seva Portal for TV and radio, as well as on the Press Council of India’s portal for print, digital, and internet media. This feature allows advertisers and advertising agencies to upload and generate a self-certification before the telecast or publication of their advertisements. These portals have been operational since June 4, 2024.

It is recommended that all FBOs ensure compliance with the directives issued by the Hon’ble Supreme Court of India mentioned above.
