Pune’s Burger King won 13-year-old case against Burger King Corporation regarding Name.

After a long battle of thirteen years, a commercial court in Pune has ruled in favor of the well-known Burger King located in Camp.

In an order dated August 16, District Judge Sunil Vedpathak dismissed the petition that the US-based global fast food giant Burger King Corporation had filed against the local establishment.

The well-known restaurant in Koregaon Park and Camp has been referred to as just “Burger” for the past 13 years after the US-based Burger King Corporation initiated legal action against it.

Years before Burger King Corporation of the United States of America registered the same name for restaurant trade services in India, the court acknowledged that Burger King Pune had been using the trade name “Burger King” since 1992.

In 2011, the USA-based company filed the case in Pune court.

The suit was initiated by Burger King Corporation represented by Pankaj Pahuja against Anahita and Shapoor Irani, owners of M/s Burger King which operates its iconic eatery at Camp and Koregaon Park areas.

The multinational had sought claims for damages and permanent ban on the use of the name.

The team of advocate Abhijit Sarwate assisted by advocates Srushti Angane and Rahul Pardeshi represented Pune’s Burger King in the case.

Burger King for its restaurant, claiming that the plaintiffs cannot have any common law rights since their restaurants do not exist in India.

The owners and operators of about 97% of Burger King Corporation eateries are independent franchisees. With 30,300 employees, the multinational company is currently the second-largest fast-food hamburger firm in the world.

The business found out that a restaurant has been running under the same name since 2008 when it first entered the Indian market in 2014 and opened locations in New Delhi, Mumbai, and Pune.

“The ruling acknowledges Burger King Pune as the honest and prior user of the name, securing a landmark victory after a legal battle. The name is well known in Pune,” the lawyers representing Pune’s Burger King stated.

This iconic restaurant in Pune can carry on serving the faithful customers under its beloved name after this order. It is now who it once was.
