A Zomato Customer Files Case in Gurugram, India against Zomato after receiving a kebab order from Lucknow in just 30 minutes. Distance between both the cities are 529 Km and by car it takes approx 8 hours to cover this journey.
The customer, Sourav Mall, had ordered four dishes from different restaurants in Delhi and Lucknow on October 14, 2023. One of the dishes was a Galouti kebab from Lucknow.
Sourav was surprised to receive the kebab within 30 minutes, as the distance between Gurugram and Lucknow is over 529 kilometers. He suspected that the kebab was not actually from Lucknow and that Zomato had misled him.
Sourav filed a case in a Delhi court, alleging that Zomato’s Legends service is misleading and fraudulent. He is seeking a ban on the Zomato Legends Service which promises to deliver food from iconic restaurants across India.
Zomato has denied the allegations, saying that the kebab was prepared in Lucknow and delivered to Sourav using a special mobile refrigeration technology. The company has said that it will contest the case in court.
Sourav is seeking a court injunction to stop Zomato’s “Legends” service, which advertises delivery of hot, freshly prepared food from popular restaurants across cities. However, Sourav alleges that the delivered food arrived in generic Zomato packaging, not the branding of the partnering restaurant. He further highlights discrepancies between the service’s advertised features and his experience, citing the “Zomato Legends” paper bag boasting freshly made (not frozen), refrigerated transport, and zero preservatives. Sourav’s lawsuit suggests these claims are misleading and violate consumer trust.
The case has raised questions about the authenticity of Zomato’s Legends service. The service promises to deliver food from iconic restaurants across India, but some customers are now questioning whether the food is actually being prepared in the restaurants that are advertised.
The case is scheduled to be heard in court on March 20, 2024.
